According to initial reports, the wreck occurred near 35th Avenue and McDowell Road. When officers arrived at the scene, they found an injured victim lying on the road. The pedestrian, who has not been identified, lost their life at the scene.

The driver who struck the pedestrian fled the scene after the accident. Roads near the scene were closed overnight but have since reopened.

Pedestrian Crashes in Arizona

In the event of a traffic collision, pedestrians have little to no protection. Two tons of steel coming at any person can cause severe injuries and even death. Even if you are taking safety provisions when crossing the road, you are still able to get hurt. Now more than ever, people drive while distracted, causing hundreds of thousands of auto accidents per year.

Aside from driver distraction, pedestrian crashes happen for many reasons. Speeding and failure to adhere to traffic rules and regulations are two common reasons pedestrian crashes happen. Motorists need to drive at safe speeds in areas around parks and schools and places where people routinely travel on foot. Pedestrians who cross crosswalks always have the right-of-way, and drivers need to be respectful of this rule.

Many pedestrian crashes also involve driver intoxication. Drunk and high driving is common even though drivers are aware that it is illegal and totally dangerous. Pedestrian crash attorneys can get you the financial compensation you deserve if you or someone you love were hit by a car while legally walking on or near a roadway. Pedestrian crashes frequently happen in Arizona and throughout the country. Unfortunately, many areas of Arizona are not designed for pedestrian travel. Additionally, drivers are not used to looking out for pedestrians in these areas.

At the law offices of Samuel P. Moeller, PLLC, we know that losing a loved one unexpectedly is one of the most painful experiences a person can go through. When a wrongful death happens due to another person’s reckless actions, the loss can be all the more difficult.

In order for dependents to be financially compensated in a wrongful death suit, they must be able to prove that their loved one’s death was caused by another entity or person and that they, the survivors, have suffered financial losses as a direct result.

Dependants of deceased crash victims may be able to be compensated for:

  • Funeral costs
  • Loss of future earnings
  • Medical care costs
  • Punitive damages if the death was intentionally caused

Contact the Phoenix wrongful death attorneys at the law office of Samuel P. Moeller, PLLC, if you have lost someone you love in a fatal pedestrian accident in Phoenix or another area in Arizona.
